i am in the 3.a. situation. what does part time mean? can you really be working part time when you are a CEO, CFO, COO, CMO of a company? not that i am raising this questions... I want to continue to be in the 3.a. situation, but can the IO ask these questions? if i make revenue of $20000 (twenty thou) and profit of $2000 a year will that be considered enough for IO to think that my intention is to switch to my company after green card and hence no intention of continuing permanent employment? or is that number higher (or lower)...
I want to become a believer in your 3.a. statement... please let me know what you think.

Personally, I want to get into 3 a, but my 140 is still pending. I plan to approach my company to switch me to EAD as soon as my 140 gets approved.

So for a position classifed as a jobzone 4 and an svp between 7 <8, which of the following job requirements would be a better option for EB-2 filing:
- MS+0 / No BS requirement
- MS+0 / BS+5
And by better I mean less chance of an audit or proof of business necessity requirements.

My understanding was that once the 485 is filed, you go by RD. It doesn't matter what your PD is...

I don't think so. Your PD is still relevent. Only those people whose PD is current will get their GCs no matter what the RD is.

With a few bills introduced or in the works, isn't it the time now to act and bring about awareness to our problems? I know IV has been working through state chapters. We can supplement those efforts with other means such as those suggested in this thread. We need to create an uproar about the hopeless situation and endless wait times due to retrogression, backlogs, and bureaucracy. I am not suggesting anything drastic. Just some peaceful ways that won't offend anybody to draw attention to the forgotten issues of EB immigrants.

I tend to disagrees with your comments, firstly please dont call this a stupid event, as a lot of young students strive to win this competition. In order to lead you have to follow, I have come across some smart ass Indians who love to talk and give directions, but they miss whole chunk of substance in their directions. (I don't mean to target you or disrespect any one else up here).
Your commments on parents motivating their childeren to strive for success in their lives, their is nothing wrong in that, would you rather have them go smoke dope and jerk around to waste their time? I am indian and proud to be, , above all proud that my parents pushed me to excel and do better with the opportunities granted to me.
However it is some desi companies who brought in the trend of lying and faking to get thie ways. But believe me , they dont get much further in their lives. I am glad strict restrictions are imposed on these companies, and the type of consultants they bring on board.
Is it fair that the person doing Masters from this country be put in the same boat as a fresh of boat from India?

Secondly, why do I see in company after company, especially in the knowledge industry that a straight A student, like your Kavya here, working for a manager who had been a B- student who in turn works for an executive who was a C- student ?
Get educated ... that's fine. But dont get over-educated such that you are a cripple who cannot think outside the box. Too much education, too many straight As, too many spellings will make you incapable of thinking outside the box, taking risks. Anyways, that's my belief and my opinion and everyone is free to raise their kids in whatever way they deem fit. I for one, would never ask my 2 children to participate in any spelling bee contest.

If the US masters degree made them super-duper smart, then they would not be knocking doors of desi companies for education after graduating.

As I understand that the Tri State area is very big and has a huge population and everyone would love to make it to the events, a lot of events are being planned.
Now for those who cannot make it to NYC, please arrange your own MEET AND GREET events in a local Starbucks or meet up in a local mall food court or any other place you think is best - conference rooms in apartment complexes are very ideal places for meetings.
We want volunteers from the following areas
(1) Long Island, farther east - till Riverhead
(2) South Jersey, West Jersey

When you "joined" them what was your situation? Were you previously on H1? When did you learn the fact that employer is not supposed to ask for money from the employees? If you knew these facts before you joined, and you joined them because of your situational needs, you may be considered a party to the fraud yourself. So if you did know about these situations beforehand, it is in your best interests to stick around till the contracted period and then decide on your next course of action.

The requirements for the position shouldn't exceed SVP time levels for the job zone to which the position code belongs - that's all I know. If the position code falls under zone IV or V you can require MS.
I still don't understand how BS+5 qualifies for EB2. If the position code falls is in zone V, BS+5 (7 years of SVP) would be a "normal" requirement, but isn't EB2 only for people with advanced degrees AND positions that require the advanced degree?

I don't quite understand how she arrived to that conclusion, that's why I'm asking on this forum in the hope that some of the folks on here who have had their PERM labor certification approved under EB2 even though their occupations were Jobzone 4 or SVP 7 <8 would share their experience and stories.

I have followed it up with AILF and 3 more attorneys just in case to see if a law suit is feasible. All of them said, it is not possible. Only option left is to write to Dept. of Justice to see if this law holds a constitutional test. I wrote once, but never got any reply on that.
But if we could take this as a group and mobilise on a mass scale to reach out to DOJ and have them review this INA law we might get attention.
Couple of points to Nay sayers.. that this is not racial descrimination
INA even though uses country of birth instead of color of skin It is still considered raical because, Under the same INA, if someone is born in a retro. country and their parents are not from that country, One could use parents country of birth.
So if a family from UK on a business to India gave birth to a child, this child is not subjected to India limits. Which means this applies only to natives from India.
I tried explaining this in my writing to DOJ. But one letter didn't do the job required.
I also think that discrimination lawsuit has very slim chances as the Supreme court ruled in the past that it's OK to have different treatment (discrimination) of non-citizens in immigration matters. But recapture lawsuit may work.

Nurses are part of EB. This nill has many benefits. More nurses will be out of greencard queue leaving others more chance. US has acute nurses shortage. It is well documented. There is not much shortage of IT professionals . Unemployment is so high. But nurses are in demand and it is important for the healthcare of the nation. Supporting the bill is a win win for everyone in EB wait.

I think it is individual decision to go back to home country or not. But taking a global look - We Indian make more money here. Average salary of Indian is $65,000+. We can save more. We get more comfortable life style. Only problem is GC, H1-B.
